The Telangana High Court granted anticipatory bail to an accused in a GST investigation involving alleged fake Input Tax Credit (ITC) claims worth ₹98.47 crore. The Court observed that custodial interrogation cannot be automatic, especially in documentary fraud cases where recovery is improbable.

Citing the Supreme Court’s judgment in Satender Kumar Antil, the Court held that police must demonstrate specific, credible needs for remand, including recovery of proceeds or thwarting criminal conspiracy. Mere invocation of large sums does not override the presumption against pre-trial detention.

Investigation must not degenerate into fishing expedition or coercive recovery mechanism.

This order reinforces personal liberty in economic offences. Counsel should highlight documentary nature of GST frauds, absence of flight risk, and willingness to cooperate to counter enforcement narratives. Bail applications must challenge necessity, not just proportionality.
