The Supreme Court has ordered the Central government to constitute a committee to investigate the practice of pharmaceutical companies offering freebies to doctors as incentives for prescribing their medicines. The direction came in Federation of Medical & Sales Representatives Association of India v. Union of India, with a bench comprising Justices Vikram Nath and Sandeep Mehta emphasizing the need for transparent evaluation of ethical and legal concerns.

The Court instructed the committee to examine representations from all stakeholders, including medical professionals, pharmaceutical firms, regulatory bodies, and consumer rights groups. The panel is expected to assess whether such practices violate medical ethics or fall foul of consumer protection and anti-kickback laws. While no specific timeframe was set, the Court directed that the committee submit its findings to the Union government for appropriate action.

Although the judgment does not impose immediate regulatory changes, it signals judicial scrutiny of commercial practices in the healthcare sector.
