The National Company Law Tribunal (NCLT) admitted an insolvency petition after finding that the demand notice issued to a personal guarantor clearly conveyed the creditor’s intention to enforce the guarantee obligation under the Insolvency and Bankruptcy Code, 2016 (IBC). The tribunal analyzed the language and context of the notice and concluded it was unambiguous in invoking liability.

The corporate applicant relied on the precedent of Innoventive Industries Ltd. v. ICICI Bank and Anr. (2017), which mandates strict adherence to Section 8 of the IBC. The NCLT held that where the notice specifies the guaranteed debt, references the guarantee deed, and demands payment from the guarantor personally, it satisfies the statutory threshold. Mere mention of the principal borrower does not dilute such enforcement intent.

This ruling underscores the necessity for precise drafting of demand notices when targeting personal guarantors.
