Kerala High Court Directs Family Courts on Adherence to Calcutta HC Guidelines

The Kerala High Court directed all family courts within the state to follow child custody guidelines formulated by the Calcutta High Court last year. This directive was issued by a Bench composed of Chief Justice Soumen Sen and Justice Syam Kumar.

The Court emphasized that these guidelines, which provide comprehensive measures for child access and custody, should be utilized until a committee in Kerala drafts local regulations. The Chief Justice noted, "This comprehensive child access and custody guidelines, along with the parenting plan, may for the time being be followed by the Family Courts in Kerala."

This ruling underscores the importance of systematic and standardized procedures in child custody cases, which can often be contentious and complex. It recognizes the need for immediate guidelines to protect children's welfare while local laws are developed.

For practitioners, this ruling ensures that there is clarity in the legal processes governing child custody in Kerala, providing a framework to encourage equitable resolutions in family law disputes.
