The Delhi High Court ruled that footpaths are strictly for pedestrian use and supported demolitions of encroachments, highlighting pedestrian rights over unauthorized structures.
Delhi HC Affirms Footpath as Public Walking Space
The Delhi High Court recently emphasized that footpaths are strictly designated for pedestrian use, as it dismissed a plea challenging the demolition of certain shanties encroaching upon footpaths. The ruling was delivered in the case of Lohar Basti Lal Bagh Azadpur Vikas Samiti v. DDA and Ors by Justice Jasmeet Singh.
The court observed that allowing encroachments on footpaths compromises public safety and pedestrian rights. The plea was brought forth by a residents' group of shanty dwellers concerned about impending demolitions, which the court refused to halt.
“Footpaths are strictly meant for walking,” stated Justice Singh.
This ruling reinforces the principle that public spaces must remain accessible to all pedestrians, without unauthorized hindrances. Legal practitioners should be aware of this decision as it establishes clearer precedence for handling encroachments on public spaces and enhances the enforcement of pedestrian rights.
